What happened on January 6th was wrong, embarrassing, and deserves condemnation. People who broke into the Capitol, assaulted police officers, and destroyed property should face legal consequences β and hundreds have. But accuracy matters, and the language we use shapes how we understand events.
Legally, insurrection under 18 U.S.C. Section 2383 requires an organized effort to overthrow the government by force. Of the more than 1,200 people charged in connection with January 6th, the vast majority faced charges like trespassing, disorderly conduct, and obstruction of an official proceeding. Only a handful of Oath Keepers and Proud Boys leaders were charged with seditious conspiracy β and even those charges fell short of insurrection. No defendant has been charged with insurrection under federal law.
The FBI's own investigation found no evidence of a coordinated, pre-planned plot to overthrow the government. A Reuters report in August 2021 confirmed that the FBI found "scant evidence" of an organized conspiracy. Most participants appear to have acted spontaneously after the rally.
Historically, actual insurrections and coups involve military units, seizure of communications infrastructure, and a clear plan to install new leadership. The January 6th rioters had no weapons cache, no military backing, no plan for what to do if they actually occupied the building, and they dispersed within hours. Comparing it to the Civil War β which killed 620,000 Americans over four years β trivializes one of the greatest tragedies in American history.
For context, the 2020 summer riots caused an estimated $1-2 billion in property damage according to insurance industry data, resulted in at least 25 deaths, and saw federal courthouses and police precincts attacked and occupied. Many of the same commentators calling January 6th an insurrection described those events as "mostly peaceful protests."
January 6th was a dark day. But inflating it into something it wasn't serves a political narrative more than historical truth. We can condemn the riot without mischaracterizing it as a military coup attempt.
How to Say It
Always lead by condemning the riot β don't appear to be defending the behavior. Then calmly introduce the legal and factual distinctions. Avoid whataboutism with the 2020 riots unless they bring up selective outrage first.
